This book was compiled by a team of authors with diverse academic and practical backgrounds, enabling it to present a broad and balanced perspective. Each chapter is designed to provide a solid theoretical understanding, enriched by empirical analysis, comparisons across legal systems, and discussions of recent cases. Topics such as freedom of contract, dispute resolution, principles of equity, and inheritance law are systematically examined to be relevant to the needs of students, legal practitioners, academics, and policymakers.
In this inaugural edition, we also present a critical approach to legal pluralism in Indonesia, particularly in the context of inheritance law, which encompasses the Civil Code (BW) system, customary law, and Islamic law. This demonstrates the importance of legal harmonization within the framework of social justice and the nation’s cultural diversity.
